Overall privacy statement
We at Livescribe Inc. take your privacy seriously. Because we gather certain types of information about the users of our website and our customers, we want to help you understand the terms and conditions surrounding the collection and use of that information. This privacy statement discloses the types of information we gather, how we use it, and how to correct or change it.
- What information does Livescribe collect?
There are a few instances where Livescribe may collect information from you. Livescribe collect information as part of operating our services and providing you with associated services. Livescribe may use technologies, such as cookies, to collect information about the pages you view, the links you click and other actions you take in relation to Livescribe services.
Livescribe may collect additional information about your interaction with our services without combining it with any personal information that will identify you as an individual. For example, to the extent you interface Livescribe services via a web browser, Livescribe receive certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access time and any referring web site addresses. When you buy products from Livescribe and our partners, we may ask you to register that product in order to gain access to support and other features. That registration may require that you provide personal information such as your name, email address, mailing address, and phone number, as well as demographic information such as your gender or occupation. When you buy or download free Smartpen application software from Livescribe and our partners, we may ask for you to provide personally identifiable information in order to proceed to check out, such as your name, email address and billing address. To use certain features on our website such as posting on our blog or in our community forums, to be notified about new products and services, or to be a part of our beta software programs, we may also require that you provide personal information such as your name, email address, zip code and country of residence, as well as demographic information such as your gender or occupation, in addition to asking you to create a unique user name and password.
Livescribe does not collect any of the content that you create with your Livescribe products without your express action and approval. Through use of your Livescribe products or Smartpen application software, Livescribe periodically collects and uses usage data, including technical information about your Smartpen, your usage of your Smartpen (e.g., monthly minutes usage), your usage of the Livescribe Desktop, your usage of Smartpen application software, and the version of your computer operating system and related system software. Such usage data does not include any of the content you create with Livescribe products.
Livescribe may collect additional information about your interaction with. There may be other times in the future when Livescribe collects personal information from you. Livescribe will always make clear what information it is requesting.
- Why do Livescribe use Your Personal Information?
Livescribe collect and use your personal information to operate and improve our services. These uses include providing you with more effective customer service; making our services easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our services and other technologies; and displaying content that is customized to your interests and preferences. We may also collect and use your personal information for administrating and maintaining other agreements and business relations that we have with our customers, suppliers and business partners.
We also use your personal information to communicate with you. We may send certain mandatory service communications such as welcome letters, billing reminders, information on technical service issues, and security announcements. Additionally, with your permission, we may also occasionally send you surveys or promotional mailings to inform you of other products or services available from us or our affiliates, and/or share your personal information with our business partners so they may send you information about their products and services. You can opt-out from receiving newsletters or promotional e-mail anytime through your preferences settings or by following the steps described in the respective newsletter or promotional e-mail.
When processing personal data for the above-mentioned purposes, we rely on legitimate interests. We have a strong interest in providing and improving our services, as well as maintaining business relationships with our customers, suppliers and business partners.
We retain personal data as long as necessary to provide our services and/or as long as there is a business relation with the company or organization that you represent or otherwise as long as it is necessary to fulfill the purpose of the processing. Personal data will also be retained as long as required by laws, regulations or decisions by authorities. If you opt-out from receiving newsletters or promotional e-mail, your information will thereafter not be retained and used for such purposes.
Personal information collected through our services may be stored and processed in any country in which we or our suppliers maintain facilities. If a business partner or a supplier is located in a country outside the US, your personal data may be transferred to a country that does not have data protection laws equivalent to ours. In those cases, we will put in place appropriate safeguards to protect your personal data in connection with the transfer. - What is Livescribe’s practice regarding cookies?
Your Internet browser has a feature called cookies which stores small amounts of data on your computer about your visit to our websites. Cookies alone tell us nothing about who you are unless you specifically give us personally identifiable information, in which case we use the information to enhance your services in the ways described below. By adjusting your settings on your browser, you may elect not to allow cookies to be collected. You need to have cookies turned on to visit and use most of the features on our websites. We use cookies in a variety of ways, including:
- Accumulating and reporting anonymous, aggregate (data collected in mass), statistical information on website usage;
- Saving your password so you don’t have to re-enter it each time you visit our website;
- Displaying information associated with you, including Livescribe store session and shopping cart information when you re-visit our website;
- Tracking affiliate and conversion data for use with our sales campaigns.
Our sites may contain links to websites owned by other parties. Those websites may use tracking technologies such as cookies in a different way than we do, and are subject to their own privacy policies.
- How does Livescribe share the information?
Personally identifiable information: We will not make any of your personally identifiable information available to other companies or people, except when:
- You specifically agree that we can share that information.
- You volunteer information or create a public profile in the course of your participation in our community features such as forums, blogs, or other forms of public communication and interaction.
- You include personally identifiable information of yourself or others in the Paper Replay sessions, audio recordings, notes, or other content (“Your Content”) you upload to Livescribe’s community features such as forums, blogs or community site. If you do, Livescribe will collect and store such information and will make it available to users to whom you’ve elected to share who could then share it with third parties. And, although Livescribe does not specifically process any personally identifiable information contained within Your Content, Livescribe may share your content—and the personally identifiable information it contains—with third-party vendors who provide us with storage and hosting services and with other entities in the case of a business transfer as described below.
- You purchase a fixed-print Licensed Application on the Livescribe Store from a third-party application developer and the third-party application developer is responsible for fulfilling your order.
- We hire third-party vendors to fulfill certain Livescribe product orders and provide services such as customer support or data processing. These companies are only allowed to use the information in order to help us fulfill those services to you. We do not provide your information to these companies for their own, permanent use.
- We are required by law, such as when we respond to subpoenas, court orders, or legal process.
- We believe that your actions violate applicable laws, Livescribe’s Terms of Use, or any usage guidelines for specific products or services, or threaten the rights, property, or safety of our company, our users, or others.
Except as described in this statement, we will not disclose your personal information outside of our company and its controlled subsidiaries and affiliates without your consent.
Aggregate information
We aggregate personally identifiable information and disclose it in a non-personally identifiable manner to our application developers and other third parties for development, marketing, promotional, and other purposes. We do not disclose to these entities any information that could be used to identify you personally without your knowledge and consent. We may provide them with aggregate information to enable them to develop and provide new products and services to our customers.
Business transfers
We are always seeking to improve our business. In accomplishing this objective, we may buy or sell a company, or one or more of the companies in our corporate family may merge with or be acquired by another company. If we sell a business, we may transfer some or all of your information as a part of the sale in order that the service being provided to you may continue or for other business purposes.
- Security of Your Personal Information
We are committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information we collect on computer systems with limited access, which are located in controlled facilities. When we transmit confidential information (such as a password) over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.
- What are my options?
If you would rather not provide any of the information requested by a registration process, you do not need to register with us and you should not purchase a Licensed Application from the Livescribe Store, as registration is required to install a Licensed Application on to your Smartpen. You will not, however, be eligible for certain support and services related to your Livescribe product or service if you do not register.
- How will I know if the privacy policy is changed?
Any modifications to our privacy practices will be reflected first within this area of our website. If there is a material change in our privacy practices, we will indicate on the privacy policy page of our site that our privacy practices have changed. If we are going to be using the information collected from users in a manner materially different from that stated at the time of collection, we will send affected users written notice of the change by e-mail.
- Privacy of children
Livescribe recognizes that parents, guardians, or other adults may purchase our products for family use, including use by minors. We do not knowingly collect personal information from children under 13 for marketing purposes. If a child under 13 submits personal information to Livescribe and we learn that that personal information is the information of a child under 13, we will attempt to delete the information as soon as possible.
- International Users
Because Livescribe users might use our products or Smartpen application software globally, we make information we gather available to our worldwide business units. If you are in the European Economic Area, please note that the personal information you provide in connection with (i) registering your product, (ii) buying or downloading free Smartpen application software, and/or (iii) uploading Your Content to Livescribe’s community features, will be transferred outside the EU/EEA for use by Livescribe and its affiliates and subsidiaries for any of the purposes described in this Privacy Policy. By using the Livescribe products or Smartpen application software, or otherwise providing us with any personal information, you consent to this transfer of this personal information and represent that you have any and all authorizations or consents that may be required to provide such information to Livescribe. You can any time contact us fore more information on such transfers and the safeguards put in place.
- Compliance with Laws and Law Enforcement Requests
We may disclose to parties outside our organization information about you that we collect when we have a good faith belief that disclosure is reasonably necessary to (a) comply with a law, regulation or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse aimed at us or third parties; or (d) to protect our or third party’s property rights. If we provide your information to a law enforcement agency as set forth above, we may remove encryption from any files containing such information before providing them to law enforcement.

You may request access to personal information hold about you by us. You may also request rectification of incorrect personal information. In accordance with applicable law, you may also request erasure of your personal information, restriction of processing your personal information, as well as to object to the processing of your personal information or make a request for disclosure of your personal information in machine-readable format.
